MTWAPA BRIDGE REGULATIONS, 1961

Regulations under section 9

1.	These Regulations may be cited as the Mtwapa Bridge Regulations, 1961

2.	A person who drives, or being the owner or person in charge of a vehicle, causes or permits any other person to drive, a vehicle in the bridge area at a speed greater than ten miles per hour shall be guilty of an offence and liable to a fine not exceeding one thousand shillings.

(1)

Subject to the exception’s referred to in clause 11 of the Agreement, there shall be payable in respect of persons, vehicles and animals using the bridge, at the time of using it, such toll fees as the company may impose, not being greater than the fees respectively specified in the First Schedule to these Regulations.

(2)	A person who uses the bridge, or causes it to be used, or attempts to use it or cause it to be used, in contravention of this regulation shall be guilty of an offence and liable to a fine not exceeding two hundred shillings.

(1)	Officers of the company whilst on duty at the bridge shall wear the uniform specified in the Second Schedule to these Regulations.

(2)	A person other than an officer of the company who wears the uniform specified in the Second Schedule, or who without lawful excuse has it under his possession or control, shall be guilty of an offence and liable to a fine not exceeding one hundred shillings.

(3)	A person wearing the uniform referred to in this regulation shall be presumed, until the contrary is proved, to be an officer of the company.

There shall be exhibited by the company at such conspicuous places as are appropriate notices specifying the toll fees chargeable in accordance with these Regulations or if the company wishes to charge a toll fee or fees lower than those specified in the First Schedule a list incorporating the lower fee or fees, and such of the provisions of the Act and these Regulations as the Minister may specify.

The Minister hereby orders that the company shall exhibit notices in accordance with regulation 5 specifying—

(a)	sections 4 and 5 of the Mtwapa Bridge Act;

(b)	these Regulations including the Schedules.
